Conveyancing Checklist For Vendors

In this vendor conveyancing checklist, we ask you for information that we need to prepare the sale documentation as efficiently as possible. Fields marked  *  are mandatory and must be filled in prior to submission. Once you have completed your form, press the submit button.

5  Sale

Sections 5 and 6 of this checklist relate to the contract of sale. The contract of sale is the document that contains all of the terms of the sale; it is typically made up of the specific details of the sale, general conditions and special conditions. It is a legal requirement that sales of real estate are in writing and signed by the parties.

6  Goods to be sold with property

Section 6 refers to movable items, such as dishwashers, plumbed in refrigerators, clotheslines, tv antenna, light fittings, window coverings, floor coverings, wall mounted televisions, stereo and cinema equipment, remote control devices, pool equipment, garden plants or furniture.

     
Are all the goods to be sold together with property?  
If no, what goods are to be excluded or removed by you prior to settlement?  
     

7  Approvals    

Sections 7 to 11 of this checklist relate to the vendor statement. A vendor statement contains information about your property and must be given to a buyer before the buyer signs the contract. A buyer may be able to withdraw from a contract if the vendor statement is incomplete or false.

     
Planning
Have any current notices been received from any Government Authorities in relation to the property? If yes, please provide copies  
Approvals
Have any building approvals been issued in relation to the property during last 7 years? If yes, please provide copies  
Were any works done by an owner/builder?  
Has any builders warranty insurance been taken out at any time during past 6 years and 6 months? If yes, provide details and copy of certificates of currency  
     

8  Services    
Is there gas connected to the property?  
If yes, provide details of the supplier  
Is there electricity connected to the property?  
If yes, provide details of the supplier  
Are there telephone services connected to the property?  
If yes, provide details of the supplier  
Is there water connected to the property?  
If yes, provide details of the supplier  
Is there sewerage connected to the property?  
If yes, provide details of the supplier  
     

9  Use of the property    
Is the property used for residential purposes?  
If no, what is the property used for?  
     

10  Tenants    
Is the property currently subject to any lease or other form of occupancy arrangement? If yes, provide a copy of the lease, licence, etc  
If yes, is the arrangement to continue after the sale of the property?  
If no, do you want Hall & Wilcox to send notice to vacate to tenants?  
     

11  Insurance    
Is the property covered by insurance? If yes, provide details and copy of certificates of currency  
     

12  Other information    
Please provide any other information you consider relevant
